SB3327 Summary

• Increases setback distance requirements for hydraulic fracturing and horizontal drilling operations from 500-750 feet to 1,500 feet from residences, businesses, schools, hospitals, nursing homes, water sources, nature preserves, and State parks.

• Expands setback protections to include farm buildings, mining operations, and State-sponsored wetlands, and requires 3-mile distance from nuclear power plants and radioactive waste storage facilities (increased from prior standards).

• Establishes 10-mile minimum distance for Class II injection wells used to dispose of hydraulic fracturing wastewater from nuclear power plants, uranium facilities, and radioactive waste storage sites.

• Prohibits compressors, dehydrators, condensate tanks, processing plants, pumping stations, open waste pits, and flares within 1,500 feet of protected structures and properties.

• Applies all setback requirements to both high volume horizontal hydraulic fracturing operations and horizontal drilling with fracturing operations (expanding coverage beyond previous high-volume only restrictions).
