IL SB3361

Amends the Illinois Wildlife Code to restrict seizure and confiscation of hunting or trapping devices, vehicles, or conveyances to instances where the illegal taking, transporting, holding, or conveying of wild birds or mammals is charged as a felony.

Authorizes the Department of Natural Resources to seize property used illegally in wildlife violations and requires an authorized employee to file a complaint in Circuit Court for forfeiture proceedings.

Requires the court to hold a hearing where the person who illegally used the property, the owner, and person in possession must appear to show cause why the property should not be forfeited to the State.

Allows property owners or persons entitled to possession to recover seized property within 6 months by providing proof of ownership and reimbursing the Department for custody expenses; allows sale at public auction if no one claims the property within that period.

Property forfeited by court order may be sold at public auction with proceeds deposited in the Wildlife and Fish Fund, and takes effect immediately upon enactment.
