IL SB3405

Adds Section 2RRR to the Consumer Fraud and Deceptive Business Practices Act to regulate patent infringement demand letters.

Prohibits sending written or electronic communications asserting patent infringement that falsely threaten legal action, falsely claim litigation has been filed, or lack reasonable basis in fact or law.

Requires patent infringement demand letters to include the identity of the person asserting patent rights, the specific patent number, and factual allegations about how the recipient's products or services infringe the patent.

Prohibits demanding compensation for patents that have been ruled invalid or unenforceable in final decisions, or for activities occurring after patent expiration.

Takes effect January 1, 2015.
