IL SB3470

Creates a new offense of criminal cannabis conspiracy under the Cannabis Control Act, making it illegal to agree with another person to commit specified cannabis offenses.

Applies to conspiracies involving possession of more than 30 grams of cannabis, manufacture or delivery of more than 10 grams, delivery of more than 2.5 grams on school grounds, or cultivation of more than 5 cannabis sativa plants.

Requires that an overt act in furtherance of the conspiracy agreement be alleged and proven by either the defendant or a co-conspirator for conviction.

Establishes that it is not a defense if the co-conspirator has not been prosecuted, convicted, acquitted, or is not amenable to justice.

Sets penalties at the same level as the underlying cannabis offense that is the object of the conspiracy, with imprisonment terms matching the minimum and maximum for that offense.
