SB3483 Summary

• Amends the Hydraulic Fracturing Regulatory Act to regulate horizontal drilling with fracturing operations in addition to high volume horizontal hydraulic fracturing.

• Requires operators to obtain consent from all owners of real property on which, under, or through which a vertical or horizontal wellbore will be drilled; where an interest has been divided, consent from those holding more than 50% of that interest is sufficient.

• Expands permit application requirements to include identification of the proposed subsurface location of horizontal wellbores, names and addresses of all surface owners under which horizontal wellbores are planned, and owners within 500 feet of the subsurface trajectory of any horizontal wellbore.

• Defines "owner of real property" to include owners of surface rights, subsurface rights, and mineral rights, replacing the previous definition of "landowner."

• Establishes that any change from the planned course of a horizontal wellbore involving real property not identified in the original application constitutes a significant deviation requiring new notice, consent, and Department approval before operations may proceed.
