IL SB3532

Amends Section 3-804 of the Mental Health and Developmental Disabilities Code to clarify that respondents are entitled to secure an independent examination by a physician, qualified examiner, clinical psychologist, or other expert of their choice.

Expands the scope of proceedings in which respondents can request court-ordered examinations to include involuntary admission proceedings, discharge proceedings under Section 3-901, and proceedings under Section 2-107.1 regarding medication or therapy.

Allows court-appointed or privately secured examiners to interview witnesses and other persons listed in relevant petitions by telephone or in person.

Establishes that the court must determine compensation for examiners, which shall be paid by the respondent's county of residence (or the county where the proceeding is pending if the respondent is not a state resident).

Removes references to Supreme Court Rules as the governing authority for determining examiner compensation, instead placing determination and payment responsibility directly with the court.
