Illinois Environmental Protection Agency maintains jurisdiction to issue Beneficial Use Determinations for asphalt roofing shingles in the state.

Senate urges the Illinois Department of Transportation not to approve recycled asphalt shingles for use in hot mix asphalt projects until receiving prior experience evaluation information from the Illinois Environmental Protection Agency as required under Senate Bill 1925.

Department should obtain verification from recyclers regarding accuracy and sufficiency of information in the Beneficial Use Determination and should not approve recyclers with pending or unresolved environmental compliance actions.

Department must annually verify the tons of recycled asphalt shingles used by each hot mix asphalt plant in Department projects and ensure usage complies with Section 4-221 of the Illinois Highway Code before approving plants for production in any calendar year.
