HB0438 Summary

• Amends the School Code to authorize school nurses and trained personnel to administer undesignated doses of opioid antidote (naloxone or similar FDA-approved drugs) to any person believed to be experiencing an opioid overdose in good faith.

• Schools may maintain supplies of undesignated opioid antidotes in secure locations where overdoses may occur, prescribed by qualified health care professionals with appropriate prescriptive authority.

• School nurses and trained personnel administering opioid antidotes must complete annual training curriculum covering opioid overdose recognition, response procedures, dosage administration, rescue breathing, and CPR/AED certification.

• Schools must immediately activate EMS and notify parents/guardians upon administering an opioid antidote, and notify the prescribing health care professional within 24 hours of administration.

• Schools and their employees receive immunity from liability and professional discipline (except for willful and wanton conduct) for administering opioid antidotes; schools must report all administrations to the State Board of Education within 3 days and submit annual reports to the General Assembly.
