HB1359 Summary

• Adds Section 2105-170 to the Department of Professional Regulation Law, establishing automatic and indefinite suspension of licenses for health care workers convicted of or pleading guilty/nolo contendere to criminal health care or insurance fraud offenses

• Applies to health care workers as defined by the Health Care Worker Self-Referral Act and covers convictions under Illinois law, other state laws, or federal law, including Medicare or Medicaid fraud

• Suspension becomes effective upon conclusion of final trial proceedings based on certified copy of the conviction or judgment

• If a licensee requests a hearing, the hearing is limited solely to determining the length of suspension, as the conviction cannot be challenged
