HB1383 - Transportation Benefits Program Act

• Creates the Transportation Benefits Program Act requiring all covered employers with 20+ employees to offer at least one transportation benefit program to covered employees working 10+ hours per week in Illinois.

• Employers may choose between two program options: (1) a federal tax-compliant program allowing employees to exclude commuting costs for transit passes or qualified parking from taxable wages up to federal limits, or (2) a program where the employer directly supplies transit passes or reimburses employees for qualified parking costs.

• Defines "public transit" as transportation systems within the Regional Transportation Authority jurisdiction and "qualified parking" as parking at or near the employer's business premises or at transit commuting locations, excluding residential property parking.

• Takes effect January 1, 2016.
