IL HB1437

Establishes the Criminal Diversion Racial Impact Data Collection Act to systematically gather and analyze racial and ethnic data on individuals diverted from the criminal justice system before court cases are filed.

Requires the Illinois Criminal Justice Information Authority to report on persons arrested and released without being charged, including their racial and ethnic composition, based on law enforcement agency data.

Requires reporting on persons with dismissed formal charges and those admitted to diversion from prosecution programs, separated by program type and including racial and ethnic composition data.

Directs the Authority to publish collected information aggregated to the county level on its publicly available website, along with an assessment of data quality.

Act takes effect January 1, 2017 and is repealed on December 31, 2020.
