IL HB1458

Establishes a Student Bill of Rights requiring schools to eliminate criminalization of minor student misconduct and regulate police questioning of students on school grounds.

Students must be informed prior to police questioning that they have the right to refuse to answer questions and that a parent, guardian, or attorney may be present during questioning.

Students must be informed that information provided to police may result in arrest, charges, and use in criminal prosecution.

School principals or designees must approve police officer presence during student questioning, except in emergency situations involving substantial risk of imminent harm.

Police cannot question students for at least 24 hours after attempting to notify parents or guardians of the opportunity to be present, unless the student is 18 years old or emancipated.
