Department of Human Services must establish a substance abuse testing program within 60 days as a condition of eligibility for Temporary Assistance for Needy Families (TANF) benefits through emergency rule adoption.

All TANF applicants must submit to substance abuse testing before a final determination of eligibility is made.

Applicants who test positive for substance abuse or refuse to submit to testing are ineligible for TANF benefits.

Applicants who test negative and meet all other eligibility requirements remain eligible, but the cost of the substance abuse test is deducted from their first benefits payment.
