IL HB3505

Creates the Smart Phone Kill Switch Act requiring all smartphones manufactured after the effective date and sold at retail in Illinois to be equipped with a "kill switch" capability that renders the device completely inoperable if lost or stolen.

Kill switch functionality must permanently remove all saved data, render the phone inoperable on any wireless network globally, prevent reactivation without password authorization, disable the device even when powered off or SIM card removed, and be reversible if the owner recovers the phone.

Prohibits wireless service providers and equipment manufacturers from charging any additional fees, surcharges, or other charges to consumers for kill switch capability.

Requires wireless service providers to provide free theft insurance for any smartphone sold in violation of this Act that lacks kill switch capability, with insurance terms to be determined by the Illinois Commerce Commission.

Wireless service providers and equipment manufacturers must ensure all smartphones sold in Illinois meet the kill switch requirements.
