School districts may discharge any unfunded mandate or requirement imposed by the School Code or State Board of Education administrative rules without compliance.

Exceptions to discharge authority include laws and rules pertaining to student health, life, or safety; federally required mandates including the No Child Left Behind Act; and laws and rules pertaining to civil rights and protections.

School districts must hold a public hearing before discharging an unfunded mandate, with notice posted on the district website at least 14 days prior and published in a newspaper at least 7 days prior.

School districts must notify affected exclusive collective bargaining agents and State legislators representing the affected territory in writing at least 7 days before the hearing, and the bargaining agent must be allowed to attend.

School boards must report each discharged unfunded mandate to the State Board of Education, which compiles and reports this information to the General Assembly annually.
