Illinois institutions of higher learning must provide incoming students the opportunity to authorize written disclosure of private mental health information to a designated person (parent, guardian, or other adult over 18).

Mental health professionals employed by the institution (physicians, clinical psychologists, or qualified examiners) may disclose a student's mental health information without authorization if they determine the student poses clear and imminent danger to themselves or others.

Mental health professionals must attempt to contact the designated person within 24 hours after determining a student poses a clear and imminent danger to notify them of this determination.

Institutions must prepare an authorization form with spaces for students to affirmatively authorize or decline disclosure and to provide the designated person's name, address, telephone number, and other contact information.

Institutions must establish policies and procedures to ensure all new students are given the opportunity to complete and submit the authorization form.
