Department of Natural Resources may vacate any plat of subdivision, street, roadway, or driveway on Department-owned lands if it determines public use or interest is served, subject to Governor approval.

Department's determination that vacation serves public use or interest is conclusive; relief from public burden of maintaining roads constitutes sufficient public interest for vacation.

Department cannot vacate any State or county highway currently maintained and used without obtaining approval from the Department of Transportation (for State highways) or the appropriate county highway department (for county highways).

Title to vacated land vests in the Department in fee simple, except where a deed or dedication instrument specifies alternative title devolution upon abandonment, or where the Department holds the land by lease or easement only.
