Secretary of State may impose a $20 delinquent registration renewal fee on passenger vehicles and motor vehicles under 8,000 pounds if renewal application is received more than one month after registration expiration, beginning January 1, 2005.

Active duty military personnel stationed outside Illinois are exempt from paying the delinquent registration renewal fee.

All fees collected are deposited into the General Revenue Fund, and the Secretary of State must adopt rules for implementation.

Secretary of State shall not impose the delinquent fee if vehicle registration expires during a period when renewal notices are not being sent to all vehicle owners with the same expiration date.

Affirmative defense available for expired registration citations issued within one month of expiration if Secretary was not sending renewal notices during that period; exemption provisions expire June 30, 2017.
