Requires courts to consider nine specific mitigating factors when sentencing individuals under 18, including age, maturity, peer pressure, family background, rehabilitation potential, and circumstances of the offense.

Allows courts discretion to decline imposing sentencing enhancements for firearm possession or discharge in cases involving defendants under 18.

Sets mandatory minimum sentence of 40 years imprisonment for defendants under 18 convicted of first degree murder in specified circumstances (prior murder conviction, multiple victims, killing peace officers or correctional employees, etc.).

Permits courts to decline firearm-related sentencing enhancements for first degree murder convictions of defendants under 18, in addition to the 40-year minimum sentence.

Applies to offenses committed on or after the effective date of this amendatory act of the 99th General Assembly.
