HB6135 - Law Enforcement Sexual Assault Investigation Act

• Requires law enforcement agencies to immediately report allegations of sexual assault by a police officer to the officer's supervisory personnel and an independent law enforcement agency.

• Mandates the independent agency (one that does not employ the accused officer) to conduct a formal investigation and provide written findings and recommendations to the State's Attorney and the officer's supervisory command.

• Allows independent agency investigation findings to serve as basis for filing charges seeking the police officer's removal, discharge, or suspension.

• Permits supervisory personnel to conduct informal inquiries into allegations unless such inquiries interfere with the formal investigation by the independent agency.

• Requires the Illinois Law Enforcement Training Standards Board to adopt written protocols and guidelines for investigating law enforcement officers accused of sexual assault, consistent with this Act.
