Expands hate crime definition to include crimes committed by reason of actual or perceived employment as a peace officer, firefighter, or emergency medical technician.

Applies hate crime penalties to assault, battery, aggravated assault, misdemeanor theft, criminal trespass, criminal damage to property, mob action, disorderly conduct, and harassment offenses.

Establishes Class 4 felony penalty for first offense and Class 2 felony for second or subsequent offense; increases to Class 3 felony for first offense when committed at religious buildings, cemeteries, schools, public parks, ethnic or religious community centers, or within 1,000 feet of those locations.

Requires trial courts to order restitution or impose a fine up to $1,000, plus at least 200 hours of community service as a condition of probation or conditional discharge.

Allows victims to bring civil actions for actual damages, emotional distress damages, punitive damages, attorney's fees, and costs independent of criminal prosecution.
