IL SB0009

Bans the sale, offer for sale, distribution, or provision of free samples of powdered pure caffeine to anyone under age 18 in Illinois or to minors purchasing from within the state.

Defines "powdered pure caffeine" as any product composed purely of caffeine in loose powdered form.

Exempts powdered caffeine products that receive explicit FDA approval as safe and effective or are lawfully marketed under an FDA over-the-counter monograph.

Establishes penalties of a Class A misdemeanor for first violations and a Class 4 felony for second or subsequent violations.

Effective date is January 1, 2016.
