Establishes fines of $75 for first offense, $100 for second, $125 for third, and $150 for fourth or subsequent violations.

Exempts law enforcement and emergency vehicle operators performing official duties, drivers reporting emergencies, hands-free device users, and drivers parked on roadway shoulders.

Creates enhanced penalties of Class A misdemeanor for violations causing great bodily harm or permanent disability, and Class 4 felony if violation results in death.
