Non-public schools may voluntarily register and seek "Non-public School Recognition" status from the State Board of Education by complying with specified procedures and requirements.

Non-public schools seeking recognition must require all employees hired after July 1, 2007, to undergo fingerprint-based criminal history records checks and Statewide Sex Offender Database checks to screen for enumerated criminal offenses and convictions within the last 7 years.

Student teachers in non-public schools seeking recognition must authorize and pay for fingerprint-based criminal history records checks and checks of both the Statewide Sex Offender Database and Statewide Murderer and Violent Offender Against Youth Database before commencing student teaching.

Public school student teachers must authorize and pay for fingerprint-based criminal history records checks and checks of the Statewide Sex Offender Database and Statewide Murderer and Violent Offender Against Youth Database prior to commencing student teaching.

Schools cannot knowingly employ persons or allow persons to student teach who have been convicted of offenses listed in Section 21B-80, found to be perpetrators of sexual or physical abuse of minors, or convicted of felonies within 7 years of application for employment.
