SB0759 Summary

• Eliminates the requirement that voters declare their political party affiliation when voting in primary elections.

• Provides that primary voters receive ballots from all established political parties nominating candidates and may cast a ballot from only one party, with limited exceptions for local political parties.

• Allows voters to mark a space on each primary ballot indicating which party they voted for, with procedures to determine which votes count if a voter marks multiple party ballots.

• Applies these open primary rules to both in-person primary voting and absentee/vote-by-mail primary voting through new Sections 19-4.5 and 20-4.5.

• Takes effect immediately upon enactment.
