IL SB0804

Amends the Counties Code to allow county boards to enact a court services fee by ordinance or resolution to defray court security expenses provided by the sheriff.

In civil cases, the fee is paid by each party at the time of filing the first pleading or appearance, with no additional fee if multiple parties are represented in a single filing.

In criminal, local ordinance, county ordinance, traffic, and conservation cases, the fee is assessed against defendants upon guilty plea, stipulation of facts, or finding of guilty resulting in conviction or supervision.

Sets a maximum fee of $25, unless the fee is set according to an acceptable cost study in accordance with Section 4-5001 of the Counties Code.

All collected fees must be deposited into the county general fund and used solely for court security expenses and other court services provided by the sheriff.
