SB1052 Summary

• Amends the Military Leave of Absence Act to make a technical correction in Section 1 concerning state employee leave for active military service.

• Employees of the State of Illinois, units of local government, public higher education institutions, and school districts who are members of U.S. Armed Forces reserves or Illinois State Militia reserves are granted leave for all periods of active military service, including basic training, advanced training, annual training, and other required duties.

• During annual training, employees continue to receive regular public employment compensation; during basic training and other military duty up to 60 days, employees receive regular compensation minus their military base pay if military compensation is lower.

• State employees and public higher education employees mobilized to active duty continue to receive state employee benefits and regular compensation minus their military active duty base pay.

• Establishes calculation methods for determining daily compensation rates for public employees and military personnel, with offsets applied to gross compensation based on the lesser of the two calculated amounts.
