SB1384 Summary

• Amends the Unified Code of Corrections to allow the Department of Corrections Director to transfer incarcerated persons to secure psychiatric units at University of Illinois hospitals, in addition to existing transfers to the Department of Human Services.

• Transfers require written consent from the person and approval from the receiving hospital, for observation, diagnosis, and treatment for no more than 6 months.

• Excludes addicts, alcoholics, and intoxicated persons from transfer eligibility under the new provision.

• Requires the Director of Corrections to file a petition in circuit court if the person does not consent, a relative objects, or commitment beyond 6 months is needed.

• Transfer to a University of Illinois hospital does not discharge the person from Department of Corrections control; they remain under DOC jurisdiction during treatment.
