Municipalities in counties with 2,000,000+ residents must regulate and inspect retail food establishments according to federal and state food safety laws, unless served by a certified local health department other than a county health department.

Municipalities may enter into intergovernmental agreements with county health departments or local health districts to perform inspection functions, with the municipality paying reasonable costs.

Low-risk retail food establishments in municipalities with 2,000,000+ residents must receive either one inspection every 2 years or submit a self-inspection report every 2 years if required by the local health department.

Local health departments developing self-inspection programs must create inspection forms and evaluation plans for Department of Public Health approval before implementation.

Department of Public Health and local health departments may adopt rules to enforce these requirements, including imposing civil and administrative penalties.
