IL SB1938

Amends the Code of Criminal Procedure to require courts to select the least physically restrictive form of treatment for defendants found unfit to stand trial who are eligible for bail or release on recognizance.

Requires the clerk of the circuit court to transmit complete copies of forensic examiner reports along with treatment orders, arrest reports, and criminal charges to the treatment facility or program.

Removes the requirement to transmit jail records and duplicate Section 104-15 reports to treatment facilities, consolidating documentation sent to receiving institutions.

Requires courts to attach a written report from a licensed physician, clinical psychologist, or psychiatrist explaining factors supporting a finding of continued unfitness when overriding a treatment supervisor's recommendation that a defendant is fit.
