IL SB2138

Prohibits snow removal and ice control services contracts from requiring either party to indemnify, defend, or hold harmless the other party for damages caused by that party's own negligence or misconduct.

Voids any contractual provision that shifts liability for one party's acts or omissions to the other party, including actions by agents or employees.

Applies only to private snow removal contracts entered after the effective date; excludes contracts with public bodies, public roads, public utilities, and insurance or workers' compensation agreements.

Defines "snow removal and ice control services" to include plowing, shoveling, de-icing, and incidental equipment operation activities.

Does not affect other legal liabilities, immunities, or defenses that may exist under separate laws.
