Daily storage charges for impounded vehicles shall not begin accruing until 5 days after the vehicle is towed and cannot exceed the maximum daily storage rate authorized by the Illinois Commerce Commission.

Counties and municipalities must notify by certified mail the lienholder, lessor, and vehicle owner within 5 days of towing, informing them of the seizure and their right to an administrative hearing.

Lienholders and lessors may take possession of impounded vehicles and defer administrative fees by submitting proof of lien, loan/lease agreement, sworn statement of default, indemnification agreement, and a payment agreement for surplus funds from repossession sales.

Municipalities must provide lienholders and lessors an opportunity to view impounded vehicles and receive a written statement of all applicable administrative, towing, and storage fees.

Vehicle impoundment authority applies to violations including DUI, driving with suspended/revoked license, operation during felonies or controlled substance violations, driving without a license, and other specified criminal offenses.
