• Law enforcement agencies may only use cell site simulator devices to locate, track, or identify communications devices, and must obtain a court order based on probable cause before any permitted use.

• Court order applications must include a description of the device's capabilities, deployment method, whether it will collect data from non-target devices, and procedures to protect privacy and delete non-target data.

• Non-target data collected from uninvolved communications devices must be deleted within 24 hours for known devices or within 72 hours for unknown devices, unless a court order preserves it under seal.

• Information gathered in violation of these restrictions is presumed inadmissible in judicial or administrative proceedings unless the State proves an applicable Fourth Amendment or Illinois Constitution exception applies.

• Court orders for cell site simulator use may be sealed for up to 180 days, with extensions available upon certification that an investigation remains active or exceptional circumstances exist.
