IL SB2406

Creates the Industrial Hemp Act authorizing cultivation, processing, possession, and sale of industrial hemp with THC content of 1% or lower by licensed persons.

Requires Department of Agriculture to issue licenses valid for 5 years to applicants providing name, address, and legal description of land to be used for growing or processing industrial hemp.

Directs Department to establish licensing rules within 180 days, including standards for licensure, fees, signage, and requiring one yearly inspection plus one surprise inspection of licensed operations.

Amends Illinois Noxious Weed Law to exclude industrial hemp from the definition of "noxious weed" and amends Cannabis Control Act to exclude industrial hemp from the definition of "cannabis."

Declares industrial hemp regulation an exclusive state power, preempting local government and home rule authority, while ensuring compliance with all federal laws and regulations.
