SB2435 Summary

• Adds power 24 to the Counties Code Section 5-1005 authorizing counties to sell or convey irregular public parcels by ordinance or resolution under procedures established in the Illinois Municipal Code.

• Defines "irregular public parcel" as vacant land with limited size or narrow configurations, parcels difficult to develop due to irregular shape, or parcels with inadequate or missing rights-of-way and utility easements.

• Creates new Section 11-76-4.3 of the Illinois Municipal Code establishing procedures for municipalities to sell irregular public parcels by staff, licensed real estate agencies, or public auction after obtaining a certified real estate appraisal.

• Allows municipalities to transfer irregular public parcels at no cost to adjoining property owners by two-thirds vote if no bids or offers are received within 6 months of the initial sale resolution or ordinance.

• Takes effect upon becoming law.
