IL SB3046

Prohibits non-violent sexual advances and discovery or perception of a person's sex or sexual orientation from serving as mitigating factors in death penalty sentencing for first degree murder (effective only if death penalty is reinstated).

Prohibits the same conduct—non-violent sexual advances and discovery or perception of sex or sexual orientation, including in dating or romantic relationships—from constituting serious provocation for second degree murder charges.

References sex and sexual orientation as defined in Section 1-103 of the Illinois Human Rights Act.

Applies restrictions regardless of whether defendant and victim had a prior dating, romantic, or sexual relationship.
