SB3292 Summary

• Requires the first offense in a habitual criminal prosecution to have been committed when the offender was at least 21 years old.

• Changes Class 1 or Class 2 felony recidivist sentencing to require convictions for "forcible felonies" rather than any felonies, and applies this standard to the prior convictions as well.

• Removes residential burglary from the list of offenses that cannot receive probation, periodic imprisonment, or conditional discharge.

• Narrows drug trafficking offenses ineligible for probation to only those involving more than 5 grams of heroin, cocaine, fentanyl, or analogs (previously 3 or more grams of heroin or analogs).
