HB0240 - Prescription Data Privacy Act

• Prohibits licensees and registrants under the Illinois Insurance Code, Pharmacy Practice Act of 1987, and Wholesale Drug Distribution Licensing Act from licensing, transferring, using, or selling prescription records containing patient or prescriber identifiable data for commercial purposes.

• Defines "commercial purpose" to include advertising, marketing, promotion, and activities to influence pharmaceutical sales, prescriber behavior, or evaluate sales force effectiveness.

• Permits limited uses of identifiable prescription data for pharmacy reimbursement, formulary compliance, care management, utilization review, health care research, and purposes otherwise provided by law.

• Allows de-identified patient and prescriber data to be collected, used, transferred, or sold by zip code, geographic region, or medical specialty for commercial purposes.

• Exempts routine pharmacy operations including dispensing medications, transmitting prescriptions between prescribers and pharmacies, transferring records between pharmacies, pharmacy ownership transfers, and care management patient communications.
