Municipalities may charge fees up to $250 per hour (not exceeding $70 per hour per firefighter) for emergency response services to hazardous material incidents.

Fire protection districts may charge the same fees for hazardous material emergency response services rendered by the district.

Municipalities and fire protection districts may also charge reasonable fees to reimburse for extraordinary expenses of materials used in emergency response.

No fees may be charged for vehicles, personnel, or equipment that are not actively used in responding to the emergency incident.

Municipalities and fire protection districts must bill for emergency response services in accordance with the fee structure established in this Act under the Hazardous Material Emergency Response Reimbursement Act.
