Department of Human Services must establish a substance abuse testing program within 60 days as a condition of eligibility for Temporary Assistance for Needy Families (TANF) benefits using emergency rulemaking procedures.

TANF applicants must submit to substance abuse testing before final determination of eligibility.

Applicants who test positive for substance abuse or refuse to submit to testing are ineligible to receive TANF benefits.

Applicants who test negative and meet all other TANF eligibility requirements must have the cost of the substance abuse test deducted from their first benefits payment.
