Public Act 100-0282 (HB0514) Summary

• Amends the Criminal Identification Act to add provisions for immediate sealing of certain criminal records when cases are disposed with acquittal or dismissal with prejudice on or after the effective date.

• Allows defendants to petition for immediate sealing of eligible records during the same hearing in which the case is disposed, without waiting periods required for other sealing petitions.

• Requires the presiding trial judge to rule on immediate sealing petitions the same day they are filed, with the court serving orders on the Department of State Police and other relevant agencies within 60 days.

• Eliminates the drug test requirement for immediate sealing petitions and simplifies service procedures by requiring petitions to be served only on the State's Attorney in open court.

• Exempts certain offenses from immediate sealing eligibility, including sexual offenses committed against minors, DUI violations, and other crimes listed in subsection (a)(3)(B) of the existing law.
