HB0624 Summary

• Amends the Fire Protection District Act to allow home rule municipalities to petition courts to disconnect territory from fire protection districts if the municipality's fire department services at least 80% of the municipality.

• Disconnection is permitted only if it will not make remaining district territory noncontiguous and will not impair the district's ability to provide adequate fire protection services.

• Territory disconnected from the district remains liable for its proportionate share of any bonded indebtedness outstanding as of the disconnection date.

• Court must set hearing within 2-4 weeks of petition filing, with 2 weeks' notice to all affected parties including the fire protection district, property owners, and interested persons who may file objections.

• If court finds petition complies with requirements and allegations are true, court shall order disconnection; circuit clerk must transmit certified copy of order to affected county clerks and the State Fire Marshal's Office.
