School districts may discharge any unfunded mandate or requirement imposed by the Illinois School Code or State Board of Education administrative rules.

Exceptions prohibit discharge of mandates related to student health, safety, or life; federally required mandates including the Every Student Succeeds Act; and civil rights and protections laws.

School districts must hold a public hearing before discharging an unfunded mandate, with notice posted on the district's website at least 14 days prior and published in a newspaper at least 7 days prior.

School districts must notify affected unions and state legislators of intent to discharge an unfunded mandate and provide them at least 7 days notice of the hearing.

School boards must report each discharged unfunded mandate to the State Board of Education, which must compile and report this information to the General Assembly annually.
