IL HB1464

Establishes state policy that pre-trial detainees shall not be required to deliver a child while in custody unless the court finds continued custody is necessary to protect the public or victim.

Requires courts to order an alternative to custody for pregnant pre-trial detainees expected to give birth in custody, unless a hearing determines release would pose a real and present threat to the victim's or public's physical safety.

Allows courts to impose electronic monitoring or other conditions on pregnant or post-partum detainees as alternatives to custody if determined to be in the best interest of the detainee and public.

Applies to all pregnant pre-trial detainees in custody on or after the effective date of this Act.
