HB2491 Summary

• Amends the Illinois Pension Code to modify how retirement benefits are calculated in Qualified Illinois Domestic Relations Orders (QILDROs) for divorced or separated spouses.

• For QILDROs issued after January 1, 2018, the gross monthly retirement benefit shall be calculated using the member's salary on the date the QILDRO is issued, rather than the salary at the member's effective retirement date.

• Applies specifically to the marital portion benefit calculation formula used to determine alternate payee shares of retirement benefits.

• Effective immediately upon becoming law.
