IL HB2540

Amends Section 10-22.31 of the School Code regarding special education joint agreements between school boards to provide educational facilities and services for students with disabilities.

Establishes procedures for school districts to withdraw from special education joint agreements, including appeal mechanisms for districts in Class II county school units outside cities of 500,000+ inhabitants.

Creates a hearing panel process for withdrawal appeals when districts are not under township school trustee jurisdiction, with panel members selected by intermediate service centers and required to meet specific residency and eligibility criteria.

Allows a specific elementary school district (maintaining grades K-8 with 2014-2015 average daily attendance of 5,209.57 and equalized assessed valuation between $451.5-$452 million) to withdraw from its six-district joint agreement upon submitting a comprehensive plan and providing at least 60 days' notice.

Takes effect upon becoming law.
