Adds new aggravated DUI offense when a violation occurs during a motor vehicle accident resulting in property damage exceeding $5,000, excluding damage to other motor vehicles.

First conviction for DUI is a Class A misdemeanor; second conviction requires mandatory minimum of 5 days imprisonment or 240 hours community service.

Third DUI violation is a Class 2 felony with mandatory minimum 90 days imprisonment and $2,500 fine if alcohol concentration was 0.16 or higher; subsequent violations carry increasingly severe felony classifications (Class 2, Class 1, Class X).

Fourth and fifth DUI violations are Class 2 and Class 1 felonies respectively, with no probation or conditional discharge available; sixth or subsequent violations are Class X felonies.

Transporting a person under age 16 during a DUI violation triggers enhanced penalties including mandatory $25,000 fines and 25 days community service in child-benefit programs.
