HB2630 Summary

• Delays the repeal of the Acupuncture Practice Act from January 1, 2018 to January 1, 2028 under the Regulatory Sunset Act.

• Expands the definition of acupuncture to include dry needling, intramuscular manual stimulation, moxibustion, herbal medicinals, natural or dietary supplements, manual methods, and exercise consistent with traditional and modern East Asian medical practices.

• Increases licensing requirements for applicants submitting applications on or after January 1, 2020 to demonstrate status as a Diplomate of Acupuncture or Oriental Medicine with the National Certification Commission, rather than just passing an examination.

• Adds provisions requiring acupuncturists to refer patients whose conditions are beyond the scope of practice to licensed physicians or dentists and permits out-of-state acupuncturists to practice during declared states of emergency for up to 30 days per calendar year.

• Expands prohibited titles and designations for unlicensed practitioners and adds new grounds for disciplinary action including failure to refer patients and misuse of professional titles or degrees.
