• Creates framework allowing Illinois Department of Transportation and Illinois State Toll Highway Authority to use design-build, Construction Manager/General Contractor, and Alternative Technical Concepts project delivery methods, subject to limits of 20% of multi-year program for Department (30% per year) and 20% of annual program for Toll Authority.

• Establishes two-phase procurement process for most design-build contracts (qualifications phase followed by proposals phase) with price excluded from qualifications evaluation; single-phase procurement allowed for projects under $5,000,000 or by written determination.

• Requires evaluation committees to be at least 50% licensed design professionals and mandates confidential pre-proposal meetings to discuss Alternative Technical Concepts; exempts these procurements from Architectural, Engineering, and Land Surveying Qualifications Based Selection Act.

• Grants Transportation Agency eminent domain and quick-take powers for property acquisition and allows combined federal, state, local, and private funding for transportation facilities.

• Makes conforming amendments to Illinois Procurement Code, Public Construction Bond Act, Prevailing Wage Act, and other statutes to authorize design-build and Construction Manager/General Contractor contracts; takes effect immediately upon passage.
