HB2816 - Materials Reuse and Recycling Act

• Environmental Protection Agency must require that at least 5% of materials used in all new construction projects are reused materials.

• Municipalities and counties are prohibited from adopting building codes that require the use of all new materials; model building codes must be adapted to allow reused, recycled, and reclaimed materials.

• Reuse of used, recycled, or reclaimed construction materials is allowed as of right in all municipal, county, and statewide building codes effective upon the Act's enactment.

• Agency must prepare an annual report to the General Assembly detailing construction and demolition waste created in the State, including types of waste, weight by type, and total weight collected.

• Act defines key terms: "reused materials" (recovered materials in same form), "recycled materials" (waste materials for reprocessing), and "reclaimed materials" (materials retrieved from original application for subsequent use).
